Texas HHSC Secures Federal Nod to Compensate Defrauded SNAP Beneficiaries

In an effort to assist victims of fraud, the Texas Health and Human Services Commission has obtained federal approval to replace stolen Supplemental Nutrition Assistance Program (SNAP) benefits. Numerous residents in Texas fell victim to skimming and cloning tactics used to obtain Lone Star numbers and Personal Identification Numbers (PINs) for unauthorized access to SNAP benefits.

The replacement of SNAP benefits aims to ensure those affected by fraudulent activities can regain access to the food assistance they need. Wayne Salter, Deputy Executive Commissioner of HHS Access and Eligibility Services, emphasized the importance of these benefit replacements in helping victims of fraud recover their funds.

To request replacement benefits, SNAP recipients who are victims of fraud must visit a local HHSC office and complete Form H1854, the Affidavit for Unauthorized Use of EBT Benefits. In cases where individuals are unable to visit an office due to factors such as age, disability, distance, or inability to appoint an authorized representative, they can request to have the form mailed to them by calling their local HHSC office. HHSC will review the claim and notify eligible individuals if they qualify for replacement benefits within two weeks of receipt.

Replacement benefits cannot exceed the amount of the stolen benefits or an amount equivalent to two months of the household’s SNAP benefits, whichever is less. Eligible SNAP households can anticipate replacement benefits issued to their new Lone Star Cards within 10 days of completing Form H1854.
